Research Master's degree in Business and Company Law

Last update: 07-11-2007

Objective of the programme: Research

Specialisation: Marketing Law

In partnership with the Faculty of Law, Montpellier I University

AIMS OF THE DEGREE COURSE

This speciality’s existence and relevance arise from several findings:

- Competition law and consumer law were really born during the 1970s in France and have steadily gained recognition. Today they are the pillars of a modern market economy in the sense that they allow it to work properly, competition law in the relations between companies and consumer law in the relations between professionals and consumers, in national law as well as Community law and international law.

- Neither competition law nor consumer law are independent from contract law, which is now taught separately; at the same time, combining these centres of interest – competition law, contract law and consumer law – forms a unit which is apparent and which provides a strong distinction from the larger and more shapeless subject of business law. It is therefore time to draw conclusions from these findings by renaming the title of this degree: Research Master’s in Marketing Law.

This must thus include all the components of a Marketing Law with boundaries to be defined:

- Competition law, contract law, consumer law: the pillars of the subject.

- Other peripheral subjects, including:

- health law,

- sports law,

- financial markets law.

Experience shows the advantages of proposing options that are in this sense more developed and diversified to students.

- Consequently, the marketing law specialisation make it possible both to provide teaching through research into the subjects covered by its field of research in order to boost the integration of motivated and well-educated students in higher education, and to offer an effective and comprehensive approach applied to topics covering marketing law.

CAREER OPPORTUNITIES AND SECTORS

Students of the Marketing Law specialisation are mainly destined to pursue their doctoral studies by preparing for and then obtaining a doctorate with a view to a university career.

However, like many Master’s in legal subjects, there are many students who profit from obtaining their third-cycle degrees, DEA or other, to find a job in the field of marketing law, as a corporate lawyer, or as a lawyer, either in government bodies, both French (DGCCRF - “direction de la concurrence, de la consommation et de la répression des fraudes”, the French Office of Fair Trading) and EU (the directorate for competition or the directorate for consumer policy, DG XXIII) or for consumer groups.
